Excavation in Hamlyn Terrace

In the Warnervale South release area, which takes in part of Hamlyn Terrace, Council's development control chapter requires every development proposal to consider the potential for existing site contamination. A preliminary assessment made during the rezoning identified sites where historic land uses raised that potential, and those sites need further investigation before the land's use changes.

The chapter lists the studies behind it, including a Stage 1 contamination assessment and preliminary acid sulphate soil assessment by Douglas Partners in 2009, and it tells assessors to consider a schedule of areas of concern. On a new block, that makes the ground's history the first thing to settle: soil dug from a flagged area is a contamination question before it is a question of where the spoil goes. This page doesn't say whether any particular lot is affected; Council's chapter and the lot's consent do.

Excavated soil counts as virgin natural material only if it comes from ground not contaminated with manufactured chemicals or process residues from industrial, commercial, mining or agricultural activity, and the NSW EPA says whoever generates it must assess past and present activities on the site and the land around it. On a lot inside a flagged area, that assessment is not a step to skip, and Council's tips accept soil only with a waste classification certificate.

Permits and Central Coast Council rules

Hamlyn Terrace's established streets, outside the release area, follow Council's ordinary controls. Low land along Porters Creek carries flood planning mapping, and there filling in flood planning precinct 2 needs a report from a suitably qualified engineer, approved by Council, which affects whether spoil from a dig can be spread on site. A house assessed by development application here is held to Council's usual limits: a cut of 1 metre within a metre of a boundary, 3 metres further in, and none inside a stormwater, water or sewer easement.
